Terms of Service
1. Scope
Our General Terms and Conditions of Sale and Delivery below apply to all deliveries of goods made by us on the basis of orders from our customers. By placing an order, the customer accepts our general terms and conditions of sale and delivery. We cannot recognize our customers' general terms and conditions of sale and delivery that deviate from our own terms and conditions.
2. Conclusion of contract
By plancing the order, thr customer enters into a binding contract. The contract comes about through the order confirmation or through delivery or performance of the ordered goods. Our customer is aware that the internet is not a secure medium of communication and that data sent via the internet can become known and be changed by third parties. The customer bears the risk that data does not reach us or arrives in a changed form. We trust that the data was sent by the customer as received.
3. Purchase price
Our prices are in euros and exclusive of statutory sales tax. Austrian sales tax rate: food items 10%, non-food, data handling, transport 20% The VAT exemption for the EU area outside Austria is only possible if the buyer has a UID number. Shipping costs and other ancillary services are shown separately. Payment transaction fees are not covered by us. When ordering, it must be specified if the transfer is from a country outside the EU so that the fee can be offset.
4. Terms of Payment
Orders are to be paid 14 days after receipt of the delivery/invoice without deduction or 7 days after receipt of the delivery/invoice -2% discount. The ordered goods remain our property until the price has been paid in full, including all ancillary fees. First orders from new customers are only accepted against prepayment. If the invoice total is over €1,000, we insist on an advance payment of 50%. If our customers are in default of payment, we charge default interest of 12% p.a. If the statutory default interest is higher, we charge this higher interest. Reminder letters that are created after the 14-day payment period has expired include a reminder fee of €7. Collection charges are to be borne by the buyer.
An assignment of rights from the contract concluded with us requires our written consent.
5. Delivery
The goods are shipped at the risk and expense of our customer to the delivery address specified by him in the order. The dispatch takes place via post, parcel service or forwarding agency. Unless otherwise agreed in writing, delivery takes place after 14 working days. Before public holidays, the delivery time for packages may be delayed.
6. Waranty and Liability
The general warranty provisions apply. We ask our customers to observe the information on shelf life and storage. We assume no liability for non-food-safe treatment of our products after receipt.
Goods that are in order and have already left our warehouse can no longer be taken back for food law reasons.
The color match between the template and the printout on the sugar plate (decorative label) cannot match 100%. Our print media are non-computer color gamuts. The print substrates are based on sugar or starch, which react violently to certain environmental influences. (humidity, cold). The greatest deviations occur in the blue/yellow mixed area. If the delivery time is too short, there is a risk that the prints have not dried properly and that they will stick together or discolour. Therefore, please allow a reasonable amount of time between the order and the desired delivery date.
We assume no liability for undeliverability or late delivery of our products due to incorrectly declared delivery addresses, absence of the recipient, customs problems or events attributable to force majeure.
Furthermore, we assume no liability for damages for whatever legal reason, if they are based on negligence.
7. Copyright
Since it is impossible to check the large number of orders, we always assume that our customer is in possession of the copyrights for graphics and photos that are orderd from us for printing. We hold the copy rights for the standard decals that we offer.
8. Miscellaneous
We use personal information from our customers, such as name and delivery address, as well as financial information, exclusively to process our customers' orders and do not pass them on to third parties. Austrian law, to the exclusion of the UN sales law, applies exclusively to the legal relationships with our customers. The place of jurisdiction for all direct and indirect disputes arising from the contract is the locally and factually competent court for 2763 Pernitz.
